Judge tosses Banks’ suit against election commission
The lawsuit brought against the Madison County Election Commission by former Supervisor Karl Banks has been dismissed.
However, the issue of contesting the election has not been decided.
Special Circuit Judge Henry Lackey ordered the suit against the commission be “dismissed without prejudice.”
According to the opinion, the election commission “is presumed to have properly performed its duties” during the Nov. 3 election.
