State law conflicts with federal rules for floodplains
PASCAGOULA, Mississippi — Amending state law to allow local governments to enforce federal floodplain codes at hunting and fishing camps is critical to ensure residents can buy property insurance through the National Flood Insurance Program.
That is the feeling of the Pascagoula City Council, at least.
The council on Tuesday passed a resolution urging Jackson County legislators to amend the law before a May 5 deadline.
The change is required, according to City Attorney Eddie Williams, because the state’s exemption on such properties from meeting flood code conflicts with federal law that requires all properties in floodplains to build to code.
Building to federal code, in turn, allows communities to participate in the NFIP and acquire cheaper insurance rates.
