Alabama, Mississippi senators say they’ll scrutinize Elena Kagan nomination
She later relented after the U.S. Supreme Court upheld legislation allowing the government to withhold federal funding from schools that did not help recruiters.
“Her actions in this case, along with other issues, will need to be addressed, and Ms. Kagan will be given a fair opportunity to respond,” Sessions said.
Both Sessions and Shelby, as well as Mississippi Sen. Roger Wicker, R-Tupelo, voted against confirming Kagan last year as solicitor general.
Mississippi Sen. Thad Cochran, R-Oxford, who did not vote on that confirmation, had no immediate comment Monday. In a release, Wicker said he looked forward to learning more about Kagan’s “experience, temperament and judicial philosophy.”
