A former Jackson police officer convicted of robbing a bank in 2005 is pinning his last hopes for freedom on proving his former attorney, a newly elected Supreme Court justice, lied.
Steve Fasano has been asking for DNA testing for several years on clothes worn by the robber in hopes of proving his innocence.
But his former attorney in the case, Jim Kitchens of Jackson — who will be sworn in as a justice in January — says Fasano balked at conducting DNA testing on the bank robber’s disguise after seeing it.
“It was the trial attorneys who informed Mr. Fasano of the possibility of having DNA testing performed on these items and on the hard hat,” Kitchens said in a sworn statement. “In consultation with those attorneys, Mr. Fasano rejected the idea of DNA testing.”
