Beef plant document subpoena draws legal fire in U.S. court

By: Magnolia Tribune - July 30, 2008

The Northeast Mississippi Daily Journal, 7/30/8

Legal arguments escalated this week over a subpoena issued for documents reportedly needed to prepare for the Aug. 25 Beef Plant trial in U.S. District Court.

Tuesday, attorneys for Carothers Construction Co. submitted a 17-page memorandum supporting Carothers’ motion to stop a subpoena of company records.

They also asked the court to waive the maximum pages of arguments to allow them “to do justice to all the issues in this case” as they seek to stop the subpoena.

The trial will focus on a 16-count indictment against three Georgia executives and their companies, which were hired by the state of Mississippi to consult on design and then construct the now-defunct Mississippi Beef Plant in Yalobusha County.
