It also said “their interest is not, was not and will not be adequately represented by neither the plaintiff nor the defendants in this matter.”

Jordan said the foremost problem with the consent decree is that the election commission and Republicans did not seek pre-approval from the Justice Department before signing it.

Also, he said the public was not given notice until an article appeared in the Jackson Clarion-Ledger five weeks after a judge approved the decree and that the state Democratic Party should have been consulted beforehand as well.

Moore and Jordan are asking Lewis to address their concerns before the Nov. 2 general election.

Brad White, state Republican chairman, said he was “in a little bit of a shock” after learning of the motion.

“I think it’s just absolutely amazing that they would object to this,” White said this morning.

He said the consent decree clearly states everything in it is already included in law.

“There’s nothing in there that’s not word for word by the election statute,” White said.

White said the reason for the delay in the announcement of the decree was that he was tied up planning a May 10 fundraiser.

Edward Course, chair of the Leflore County Election Commission, said he had no comment.

“I’m through with that,” Course said. “It’s water under the bridge.”
