Supreme Court upholds MDOC firings in 2004

The removal of job protections for employees of the Mississippi Department of Corrections in 2004 as a cost-cutting tool was constitutional, the state Supreme Court has ruled.

The decision came in a lawsuit filed by former MDOC employee Gary Hemba, who was one of 160 workers fired by MDOC in 2004.

The Legislature in 2004 removed civil service protection for MDOC workers for one year at the urging of Gov. Haley Barbour.

Hemba alleged the action was unconstitutional because the bill dealt with budgeting issues and as such amended state personnel laws by reference.
