Contentious State Farm case settled for $250,000
The McIntoshes’ attorney, William F. “Chip” Merlin, said the couple wants to move on with their lives.
“I can say that the State Farm counsel have done an extraordinarily good job protecting State Farm,” said Merlin, a Florida insurance attorney who represented the McIntoshes after Scruggs bowed out of Katrina cases in December.
Merlin said a motion the McIntoshes filed last week asking a federal judge to dismiss their claim for punitive damages was part of the settlement agreement. U.S. District Judge L.T. Senter Jr. dismissed the remaining breach of contract case Monday after the settlement.
In last week’s motion, the McIntoshes acknowledged that State Farm “had a reasonable basis for taking the position it did regarding coverage.”
The McIntoshes were promptly and properly paid policy limits of $350,000 for flood damage and $36,228 for wind damage before an engineer inspected their property, the motion said.
