Statute won’t permit Southaven Mayor Davis’ removal, state official says
Southaven residents leading a petition drive asking Gov. Phil Bryant to remove Mayor Greg Davis from office are pinning their hopes on a state statute they believe covers municipal officials, but a spokesman for the Attorney General’s Office said Tuesday the provision doesn’t apply.
The Concerned Citizens of Southaven group has collected about 1,000 signatures demanding the removal of Davis, under fire for misspending thousands of dollars in public funds. The group went door-to-door last weekend collecting petition signatures.
Organizers are basing their effort on Mississippi Code Title 25, Section 5-7, which covers the removal of elected officials from county offices by the governor. The statute allows the state’s chief executive to remove “any elective county officer,” provided petitioners making up at least 30 percent of the county’s qualified voters demand the removal.
