Melton to argue for place on ballot Wed.

By: Magnolia Tribune - March 20, 2009

The Clarion-Ledger, 3/20/9

Mayor Frank Melton is scheduled to appear in court Wednesday to fight for a spot on the May 5 Democratic primary ballot.

The hearing is set for 1:30 p.m. at Hinds County Circuit Court.

Melton filed a lawsuit this week to challenge a ruling by the Jackson Democratic Municipal Executive Committee, which pulled him from the ballot.

The committee decided unanimously at a meeting Tuesday that Melton did not meet the city’s residency requirements because he files for homestead exemption in Texas, not Jackson.

Melton’s attorney, John Reeves, said Circuit Court Judge Billy Joe Landrum of Jones County has been assigned to hear the case.

Mississippi law requires judges from outside the county to hear cases involving local election disputes.
