The Scruggs defense team has asked Judge Biggers to please let Ken Coghlan enter an appearance as a lawyer for Dickie Scruggs (in spite of the obvious conflict of having represented Steve Patterson in this case for a couple of weeks), and, in doing so, noted an intention to consult with him on local practices and jurors even if he’s not allowed to formally appear. The motion notes that both Patterson and Scruggs have entered written waivers to Coghlan’s appearance.
The smart money says that once Judge Biggers has said “no” twice, he’s likely to say no again.
