As the quotes in the defense motion to continue make clear (a PDF of the defense motion to continue is here), the defense strategy is apparently going to be that Balducci was acting on his own in paying $40,000 to Judge Lackey to get action favorable to the Scruggs side, and that Scruggs had nothing to do with Balducci’s acts.
