Police agree texting law is ineffective
Law enforcement officials in Madison County are all in agreement that the texting and driving law that went in effect July 1 is ineffective in its current form and nearly impossible to enforce.
The violation is civil, not criminal, so tickets would have to be issued in Justice Court.
“My thoughts on the bill is that it was poorly written or the legislature just wanted enforcement from county sheriffs and (Mississippi Highway Patrol), since their tickets are already processed through Justice Court,” Flora Police Chief Dwayne Moak said….
…Madison County Sheriff Randy Tucker said he and other law enforcement officials are awaiting Attorney General opinions and have issued no tickets either.
“I felt all along that’s going to be hard to enforce,” he said.
“As far as observing somebody driving down the road, it’s hard to determine if somebody is dialing the phone.
