Zach Scruggs hearing on disqualification is this morning
Right at the close of business on Friday, the Government filed a motion to allow surrebuttal on the issue, including with it argument, pleadings, and transcripts designed to establish that Zach Scruggs had already litigated and lost all of the issues he’s raising as prosecutorial misconduct, prior to his guilty plea. Zach Scruggs responded with a very barbed opposition to allowing surrebettal– the Government argues it should be allowed surrebuttal because Zach Scruggs changed the nature of his argument by abandoning the argument about Norman being a witness, and Scruggs responds that these issues were raised in its first motion.
