Criminal trial delayed for areospace engineers pending lawsuit

A federal judge has postponed the criminal trial of five former Eaton Aerospace engineers until a theft-of-trade lawsuit regarding the same matter is finished.

That’s the reverse of what is typically seen with criminal prosecutions, said Matt Steffey, professor at the Mississippi College School of Law. “It is unusual, which isn’t to say there’s anything wrong with it.”

U.S. District Judge William Barbour Jr. wrote he was granting the delay because “this case is so unusual and complex due to the nature of the prosecution, the number of defendants and the volume of discovery that it is unreasonable to expect adequate preparation for pretrial proceedings or for the trial itself within the time limits established by the Speedy Trial Act.”
