YP – Judge grants Scruggs’ motion to stay Wilson v. Scrugs 2.0, denies motion to dismiss

Judge grants Scruggs’ motion to stay Wilson v. Scrugs 2.0, denies motion to dismiss

This cause comes before the court upon the Scruggs Defendants’ Motion to Dismiss, to
Stay Pending Resolution of State Court Action, or to Stay Pending Resolution of Federal
Criminal Action. Defendants Patterson and Peters have joined the motion.
The plaintiffs brought the present case seeking compensatory and punitive damages as a
result of an attempted bribe of Hinds County Circuit Judge Bobby DeLaughter. DeLaughter has
been charged for his alleged role in this matter and is awaiting an August 17, 2009, trial in this
court before Senior United States District Judge Glen H. Davidson. The defendants move the
court to stay the present case pending resolution of DeLaughter’s federal criminal action.
Upon due consideration and finding good cause shown, the court finds that the
defendants’ motion should be granted in part. The court finds that the present case should be
stayed pending the trial of Bobby DeLaughter in Criminal Action No. 3:09CR002-D-A. The
court will only stay this case until the conclusion of said trial. This ruling does not apply to any
potential activity in that case beyond the trial. The court denies the alternative motions to
dismiss and to stay pending resolution of the state court action.

It is, therefore, ORDERED AND ADJUDGED that the Defendants’ Motion to Dismiss,
to Stay Pending Resolution of State Court Action, or to Stay Pending Resolution of Federal
Criminal Action is GRANTED in part and DENIED in part. The defendants’ motion to stay
in regard to the above-referenced federal criminal action is GRANTED, and this case is hereby
STAYED pending the conclusion of the trial in that cause. The remaining motions are
DENIED.
