Hinds County Circuit Judge Tomie Green is expected to rule today on whether to overturn Gov. Haley Barbour’s decision to place the special Senate race at the bottom of this November’s ballot.
Pike County Election Commissioner Trudie Berger has filed a lawsuit asking Green to place the special election between Republican Roger Wicker and Democrat Ronnie Musgrove near the top of the ballot.
Green held a hearing on the issue Thursday morning – a day after a three-judge panel of the Supreme Court overturned a temporary restraining order she had issued in the case.
Green’s restraining order had prevented Secretary of State Delbert Hosemann from sending to the county election commissioners the “official sample ballot” approved by Barbour with the Wicker-Musgrove race at the bottom of the ballot.
