Ex-lawyer presses court for freedom

By: Magnolia Tribune - September 4, 2008

The Clarion-Ledger, 9/4/8

Former Mississippi trial lawyer Paul Minor, convicted in March 2007 of bribing two judges, is asking the 5th U.S. Circuit Court of Appeals to reconsider his petition to get out of prison.

The 5th Circuit last month denied Minor’s appeal of an order denying him bail.

The court said the 62-year-old Minor failed to show he would not pose a danger to the community if released.

In the petition for a reconsideration, Minor’s attorney, Abbe Lowell, says the U.S. District Court decision to keep Minor in prison “failed to state any reason to justify Mr. Minor’s continued detention” and that federal court rules require an explicit explanation. “Specifically, the district court made no finding on the record that Mr. Minor now poses any sort of danger to the public,” according to the petition for a rehearing. “Consequently, Mr. Minor’s detention is not supported on the existing record, and a remand is warranted.”
