YP – State Farm serves Scruggs subpoena and makes case against Jim Hood

In documents filed late today, State Farm’s attorneys have now served Dickie Scruggs for a deposition to be held in Scruggs office on Friday February 1, 2008.

From the looks of it, it seems that Scruggs is not fighting the subpoena, at least at this point. However, it is conceivable that he could later seek 5th amendment protection for any or all of his testimony. Suffice it to say that Friday, February 1, 2008, and the days leading up to it will be interesting indeed.

State Farm also filed a very detailed motion to the court outlining their arguments against Jim Hood restarting an investigation. It has a few basic points.

1. Hood agreed by contract not to do it
2. Even if he could, Hood does not have jurisdiction to investigate a potential federal violation (non-compliance with the National Flood Insurance Program – NFIP) as he is attempting to do
3. Hood via Moore and Scruggs was specifically attempting to coerce civil settlements via coordinated criminal investigations that would enrich his campaign contributors
