What the defense will say about Balducci and Lackey, Part 1 (by NMC)

The motion to continue states that the defense will be filing a motion to suppress the search warrant of Scruggs law office. A motion to suppress is an argument that evidence the government has seized was seized in violation of constitutional rights, such as the right against unreasonable searches and seizures secured by the Fourth Amendment. To obtain a search warrant, the government has to provide probable cause in the form of reliable information that there is a reason for the search. Scruggs is going to argue that the government lied in the application for the search warrant by misstating what transpired between Judge Lackey and Tim Balducci.
