Again, the Legislature has the final say in calling contested elections and seating its members and that cannot be contested to state court. But individual voters could potentially have an actionable federal cause if they could prove their votes were improperly canned by the House. It would probably be a legal long-shot, and resolution could take time.
Democratic legislative leaders on Thursday, as lawmakers were leaving town in front of foul winter weather, were talking up the potential for such litigation in what one House leaders has already called “the race that keeps on giving.”
