U.S. Senator Thad Cochran (R-Miss.) today supported Senate passage of legislation to preserve the rights of workers and employers when presented with the question of affiliating with a labor organization.
Cochran is an original cosponsor of the Congressional Review Act on Ambush Elections (S.J.Res.8), which the Senate approved Wednesday (53-46). This resolution of disapproval would block a new National Labor Relations Board (NLRB) regulation aimed at strengthening labor unions at the expense of private-sector employers.
“Our economy thrives when companies and their employees can make decisions about what’s best for them without undue interference from government regulations like the one proposed by the National Labor Relations Board. This flawed plan would strengthen labor unions mainly at the expense of small businesses across America and hold back our future economic growth,” Cochran said. “I’m proud to cosponsor this resolution to block this proposed regulation and support our pro-growth agenda.”
In December 2014, the NLRB issued a final rule making significant changes to union representation election procedures. This new rule “ambushes” employers by shortening the time between a union petition and a representation election from the current median of 38 days to as few as 11 days. This rule provides employers only seven days to find legal counsel and appear before a NLRB regional office at a pre-election hearing, in contrast to the unlimited time given to unions to conduct their organizing campaigns before unveiling a petition.
