Rossmiller tonight posted this Exhibit to a discovery motion. In this letter, the Government outlines what they have turned over.
There are some very interesting questions raised.
On page 4, the Government states that it turned over . . .
“November 5, 2007 Surveillance Photos” with photographs showing $10,000 check paid from Scruggs Law Firm to Tim Balducci, the letter from Richard “Dickie” Scruggs to Tim Balducci, and documents related to that transfer. Also included are photographs of Tim Balducci’s vehicle parked outside the bank in which he deposited the check.
This certainly begs the question of whether Balducci was cooperating at this point. It would seem a bit of overkill for the Government to be snapping surveillance photos of Balducci depositing the check if he were already flipped.
On page 3, item 15 notes email between Balducci and Backstrom on 11/26 from 9:08-9:31 a.m. Scruggs’ offices were raided the next morning. I can’t wait to see what that says, but again, it begs the question, if Balducci were flipped, what would he be talking to Backstrom about via email one day before their office is raided.
There are several phone number listed for wiretaps. Since they talk about “subscriber information”, it could well be cellphones.
Page 3 notes that Patterson was interviewed by the FBI on the day Scruggs’ office were raided . . . one day before the indictments.
