Reports: Obama administration to issue directive on transgender bathroom use
The Obama administration will issue a decree directing public schools to allow transgender students to use bathrooms that match the gender they identify with, the New York Times reported.
The letter will go out Friday, the Times said, but is not enforceable by law.
However, the letter “contains an implicit threat: Schools that do not abide by the Obama administration’s interpretation of the law could face lawsuits or a loss of federal aid,” the Times reports.
“A school may not require transgender students to use facilities inconsistent with their gender identity or to use individual-user facilities when other students are not required to do so,” according to the letter.
