DuPree asks judge to rule before trial

In a motion filed yesterday, Hattiesburg Mayor Johnny DuPree is requesting specially appointed Judge William Coleman to issue a summary judgment in his favor.

DuPree’s motion argues if allegations of improper voting were true he would still win by four votes over Dave Ware.

The final margin of victory after a nearly two-day absentee and affidavit vote count found DuPree the winner by 4,775 votes to Ware’s 4,738, just 37 votes.

DuPree’s motion says of 39 ballots Ware’s complaint states should not have been counted, 36 were votes for DuPree and 3 for Ware. The resulting total gives DuPree 4,775 votes to Ware’s 4,735.
