Hood – Supreme Court trumps Mississippi’s immigration laws
The ruling by the U.S. Supreme Court on the Arizona immigration law trumps two current Mississippi laws, state Attorney General Jim Hood’s office confirmed Wednesday afternoon.
The two pieces of legislation affected are a part of a larger package referred to more commonly as the Mississippi Employment Protection Act.
“The Supreme Court’s decision in Arizona v. U.S,” an email from the AG’s office stated late Wednesday, “makes it clear that federal immigration law preempts Mississippi law…which creates a criminal penalty against an illegal alien for accepting employment.”
“Mississippi Code Section 71-11-3 (4)(d), which creates a cause of action against employers who discharge legal resident employees while retaining an illegal alien employee, could also be preempted under the decision.”
