Jimmy Gates – What are Ed Peters documents 1, 2 and 3?

A judge will decide whether all documents from an investigation to determine if then-Hinds County Circuit Judge Bobby DeLaughter was improperly influenced during a civil case by former Hinds County District Attorney Ed Peters should be kept confidential.

Hinds County Circuit Judge Swan Yerger also will decide if some documents from the investigation can be given to federal prosecutors or other government officials to determine if there was any criminal wrongdoing on the part of DeLaughter and Peters.

Those were the two main points from a nearly 90-minute hearing Tuesday involving attorneys from two aerospace companies locked in a legal battle over Peters’ involvement in their lawsuit and what can or cannot be made public. The actual lawsuit, however, has nothing to do with Peters, but is about the alleged theft of trade secrets by one of the companies’ former employees.

Eaton has argued to keep many court papers sealed, including Yerger’s order for Peters to give a deposition. Peters’ transcript, however, would be sealed until the court makes a final determination, Yerger ruled.

Eaton withdrew a request to close Tuesday’s hearing.

Attorneys went back and forth about a key document referred to only as Peters 1, 2 and 3 without explanation. Frisby attorneys said it was a document sent by Eaton to DeLaughter.
