Ex-bodyguard again seeks separate trial from mayor’s

Attorneys for one of Mayor Frank Melton’s former bodyguards filed another motion Monday in federal court seeking a separate trial from the mayor’s.

This is the second filing by Michael Recio’s attorney, Cynthia Stewart, asking that Recio be tried alone.

The motion says Recio did not help destroy a duplex on Ridgeway Street on Aug. 26, 2006, and was not part of an “official observation” of the the events. Recio wants Melton to testify on his behalf, and the motion includes a signed statement from Melton detailing the night’s events.

Both Melton and Recio are due in court Nov. 12 to stand trial on civil rights charges related to the 2006 raid on the duplex. Former bodyguard Marcus Wright pleaded guilty last week to a related misdemeanor conspiracy charge and agreed to assist prosecutors.
