Medicaid: Barbour seeks a judicial solution
Locked in stalemate with the Legislature over the Medicaid special session, it seems Gov. Haley Barbour is hoping for a judicial solution to a problem he hasn’t been able to win a legislative victory to solve.
This just in from the Governor’s Office:
“I have directed the Mississippi Division of Medicaid to file a
motion today asking Judge William H. Singletary of the Hinds County
Chancery Court to expedite his ruling in a lawsuit challenging the
agency’s authority to increase gross revenue assessments on hospitals as
a means of funding the program. I believe now as I did when Medicaid
initiated the action in 2006 that there is ample legal authority to make
such a change.
“Since the Legislature has now had more than two years to enact a fair,
permanent, sustainable solution to Medicaid funding, but has failed, it
is very appropriate for the Court to expedite its ruling. Toward that
end the Division of Medicaid will seek a hearing in Judge Singletary’s
Court as soon as possible.”
