Attorney General Jim Hood is asking Gov. Haley Barbour to join him in court action to determine the special election date to fill the U.S. Senate vacancy being left by Trent Lott.
In November, Lott announced he will retire from the Senate this month in the first year of his fourth six-year term.
Disagreement has arisen over when a special election would be held to replace Lott.
Republican Gov. Haley Barbour, who will call the special election, said he will set it for Nov. 4, the general election. Democratic Secretary of State Eric Clark has said he agrees the election can be postponed until then even though an unofficial 2004 opinion in Clark’s office said the election must be held within 100 days of the resignation.
