CL – Wrongful death lawsuit sparks tort reform debate
Once again, trial lawyers and the state’s business and medical interests are at odds over a wrongful death lawsuit and disagree over whether the state’s tort reforms over the last decade are being undermined.
The state Supreme Court on Dec. 3 rejected a request by Gov. Haley Barbour and the Mississippi State Medical Association to reconsider a decision that revived a wrongful death lawsuit.
In its July 23 decision, the Supreme Court concluded a judge erred when he tossed out Nina Price’s negligent death lawsuit on the basis of the statute of limitations. In 2004, Price sued the doctors, clinics and hospitals in the Delta that failed to diagnose a pituitary tumor that killed her husband, Albert Jr., earlier that year.
