Judge to rule on Wicker-Musgrove ballot

Green appeared skeptical while listening to the attorney for Secretary of State Delbert Hosemann argue that there is no specific law addressing ballot order for special elections such as this race.

“But the law does say special elections should be separated from general elections .. and the historical practice is to put them at the end of the ballot,” John Henegan, a private attorney representing the defendants, told the judge.

“There evidently is something else going on that would make you take a Senate office and put it at the back of the ballot,” Green said.

Although the state high court dissolved her order, it said all other issues should be presented to the trial court for considerations.
