I’m sure I’m not alone in wondering whether RICO (the Racketeer Influenced Corrupt Organizations Act — here’s a quick plain-English overview of the topic) might come into play in U.S. v. Scruggs. Especially since forfeiture of corrupt gains is part of the play, isn’t the filing of RICO-based charges generally a pretty attractive idea to prosecutors?
Would y’all who have experience in RICO practice — either side of the v. — care to enlighten us who don’t about what you do or may expect on this front in this case? If so, please try to phrase what you say in English rather than Legal so we non-lawyers don’t end up lost in the weeds.
