That issue was raised by Eaton Aerospace of Jackson in its lawsuit against North Carolina-based Frisby Aerospace.
Eaton had claimed that six former employees took with them to Frisby a computer database that contained Eaton trade secrets.
Hinds County Circuit Judge Swan Yerger threw out the lawsuit last year. Yerger said Eaton had hired former District Attorney Ed Peters as outside counsel with the hopes he could influence Judge Bobby DeLaughter, who initially presided over the litigation.
Eaton has filed an appeal with the Mississippi Supreme Court.
