Miss. media granted access to DeLaughter’s sentencing letters

OPINION GRANTING MEDIA ACCESS TO PRESENTENCE LETTERS The cause comes before the Court on the motions of Paul Quinn and Journal Publishing Company for access to the presentence letters written to this Court in the above-entitled action. Very similar motions were filed in USA v Richard Scruggs, et. at., No. 3:07CR192 (N.D. Miss. 2008) and USA v. Joseph C. Langston, No.1 :08CR03 (N.D. Miss. 2008), and were granted. The Court adopts the reasoning and rationale set forth by the Honorable Neal Biggers, Jr., Senior United States District Judge for the Northern District of Mississippi, in USA v Richard Scruggs, et. at., No. 3:07CR192 (N.D. Miss. 2008) and by the Honorable Michael P. Mills, Chief Judge for the Northern District of Mississippi in USA v. Joseph C. Langston, No. 1:08CR03 (N.D. Miss. 2008). THEREFORE, it is hereby OROERED, that Paul Quinn’s motion for access to presentencing letters (docket entry 110), as well as Journal Publishing Company’s motion (docket entry 111), are GRANTED. The movants may examine, but not photocopy, the requested information in the office of the clerk of court in the United States Courthouse in Aberdeen, Mississippi, on Thursday, November 12, 2009, from 1:OOpm until 5:00pm and on Friday, November 13,2009, from 9:00am until 12:00pm.
