IN THE UNITED STATES DISTRICT COURT
FOR THE NORTHERN DISTRICT OF MISSISSIPPI
WESTERN DIVISION
UNITED STATES OF AMERICA PLAINTIFF
VERSUS CRIMINAL ACTION NO: 3:09-CR-00002-GHD-SAA
And 3:09 CR 00002 NBB-SAA-2
BOBBY B. DeLAUGHTER DEFENDANT
MOTION FOR ACCESS TO PRESENTENCING LETTERS
CONCERNING DEFENDANTS
Comes now Journal Publishing Company, which publishes the Northeast Mississippi Daily
Journal and related newspapers in Northeast Mississippi, by and through counsel, and moves the
Court for access to pre-sentencing letters concerning the Defendant, Bobby B. DeLaughter, in the
above-styled matter, and would show that this Court has previously granted access to similar presentencing
letters regarding the defendants in United States v. “Dickie” Richard F. Scruggs, et al
(Cause No. 3:07-CR-00192 NBB-SAA, Docket Nos. 207, 211, 214, 217 and 268) allowing timelimited
access to the letters regarding said co-defendants in the office of the clerk.
For the same reasons set forth in the Movant’s previous Motions in United States vs. Scruggs
(Docket No. 215), adopting the rationale set forth in the Motion filed on behalf of Gulf Publishing
Company (Docket No. 205), and relying on the reasoning set forth in the Court’s Order Denying
Motion to Reconsider (Docket No. 209) in U. S. v. Scruggs, the Movant respectfully requests access
to the pre-sentencing letters concerning the Defendant, Bobby B. DeLaughter.
Respectfully submitted,
HOLLAND, RAY, UPCHURCH & HILLEN, P.A.
