AG: Miss. Senate must OK MDOT head

By: Magnolia Tribune - March 19, 2009

The Clarion-Ledger, 3/18/9

In an opinion made public today, Attorney General Jim Hood said Mississippi Department of Transportation Executive Director Butch Brown must be reconfirmed by the state Senate in order to serve another term as the agency’s chief.

Senate Highways and Transportation Committee member Hob Bryan, D-Amory, requested the opinion. Brown said he learned of the opinion earlier this week.

“If that’s the law, then that’s the law,” he said.

Brown was named to head MDOT in 2001 and was confirmed by the Senate at that time. He was fired in 2004, only to be rehired a few weeks later.

“Because I had been terminated before, I went back through confirmation then. We felt like it was a formality, but we did it anyway,” he said.
