Entergy takes PSC to court over rate hike

Entergy Mississippi is challenging the state Public Service Commission’s recent denial of its request for a $3.7 million base rate adjustment.

In an appeal filed recently with the state Supreme Court, Entergy argues that the commission has violated the company’s “constitutional rights” and caused the company’s rates to yield less than a “fair, just and reasonable rate of return.”

“The commission’s denial … is not supported by substantial evidence and is contrary to the manifest weight of the evidence,” the appeal states.

Public Service Commission Chairman Lynn Posey said the commission rejected Entergy’s base rate increase earlier this month because members had just learned of a separate matter in which the company may have been overcharging Mississippi customers.
