Earl Wesley Berry’s execution was stopped in October just hours short of his lethal injection for killing Mary Bounds in Chickasaw County.
Monday, Attorney General Jim Hood filed a motion with the Mississippi Supreme Court to set a new date so that Berry can be executed by May 5.
His actions followed a Monday morning ruling by the U.S. Supreme Court clearing the way for Mississippi, Alabama and Texas to set new dates for three inmates granted last-minute reprieves by the justices last year.
“Our filing today will request that an execution be set to take place within 30 days,” said Hood in an e-mail statement. However, his court filing asks for execution within two weeks.
