ATTORNEY GENERAL HOOD FAILS TO PROSECUTE OBSCENITY
Send An Email To Mississippi Attorney General Jim Hood. Ask Him To
Keep His Promise To Prosecute Those Who Distribute Obscenity In Our
State.
On November 18, 2005, Mississippi Attorney General Jim Hood made a
promise to me that he would vigorously enforce our state’s obscenity
statute.
During a personal visit with Mr. Hood, I handed him a list containing
the addresses of at least 15 Movie Gallery video stores in our state
that were selling hard-core pornography.
When I handed him the evidence my staff had collected from some of
these stores, Attorney General Hood agreed that the material Movie
Gallery was selling was prosecutable. The following February (2006),
Mr. Hood’s office wrote to me, “We have verified the presence of
these materials at various locations throughout the state.”
By September, nothing had happened. A staff member from AFA, Randy
Sharp, went to Jackson and met with Mr. Hood’s staff. Randy presented
affidavits and evidence of Movie Gallery’s activities. AFA was hopeful
Mr. Hood would take action and enforce obscenity laws this time.
Here is a time line of our efforts.
* October 2005 – Called the Attorney General’s office to request a
meeting regarding movies being sold and rented in Movie Gallery
stores.
* November 2005 – Mr. Hood visits AFA. We provide a list of Movie
Gallery stores with back rooms selling pornography.
* December 2005 – Mr. Hood assigns case to Lee Martin, Asst. AG
* February 2006 – In an e-mail from Mr. Martin, he verifies the
“presence of these materials at various locations throughout the
state.”
* August 2006 – Case is turned over to Asst. AG Scott Johnson.
* September 2006 – AFA staff person Randy Sharp meets with Mr.
Johnson in his Jackson office. Mr. Johnson told Randy that he has
successfully prosecuted obscenity in the past and is prepared to file
charges. Several calls and emails after this time were not returned.
* Oct. 29, 2007 – Mr. Johnson says the case has been turned over to
Asst. AG Brandon Ogburn. A message to his office has not been
returned.
It has been almost two years since Attorney General Hood promised to
do something about the scourge of obscenity in our state. Nothing has
been done.
TAKE ACTION
Send an email to Mississippi Attorney General Jim Hood. Ask him to
keep his promise to prosecute those who distribute obscenity in our
state.
