Upper Level ordered to close

Saying the evidence validates the Upper Level club as a “public nuisance, Hinds County Chancery Judge Dewayne Thomas on Monday ordered the Jackson nightspot temporarily closed.

But Thomas left open the possibility of the club reopening if the owners meet certain requirements, including:

Purchasing a $1 million premises liability insurance policy.

Immediately hiring at its own expense an experienced security individual or company meeting the Jackson police chief’s approval.

Providing copies of each employee’s personnel file within 48 hours of the order being filed with the court.

Allowing officers from the Jackson Police Department and the Hinds County Sheriff’s Department to enter the premises at any time.

Thomas is requiring Upper Level owner Sandra Moore Johnson to post a $50,000 bond that will be forfeited to the city of Jackson if she violates the injunction.
