Today, Jim Hood’s office announced a lawsuit against Entergy over their lack of willingness to submit to a document fishing expedition that, according to Entergy, the AG does not have standing to conduct. Entergy has already submitted to hearings in front of the PSC on these exact issues and Hood’s office has been involved in those hearings. What you won’t read about in the Clarion Ledger is the fact that Hood had been sued by Entergy in Federal Court a few weeks ago on 4th Amendment grounds, and this effort in Hinds County Circuit court is an attempt to end-around that lawsuit.
No word on whether Judge Tomie “IHOP” Green has been assigned the case, or if so, whether or not she has already given Hood’s office a Summary Judgement.
As most people know, Entergy is regulated by (1) FERC – the Federal Energy Regulatory Commission and (2) the MPSC – the Mississippi Public Service Commission and that those two agencies have the rights to regulate and oversee the activities of regulated utilities.

Indeed.
The bottom line is that the only people who will get screwed on this is the taxpayers, who will be forced to fund both sides of this fight. The only question that remains now is which contributor to Jim Hood’s campaign will wind up with this potentially lucrative legal work.
